Terms of Service

These Terms of Service ("Terms") set forth the conditions for use of the smartphone application Kyoiru|Family Check-In ("Service") provided by corecty Inc. (株式会社corecty, "we," "us," or "our"). Please read and agree to these Terms before using the Service. By using the Service, you are deemed to have agreed to these Terms.

Article 1. Definitions

The terms used in these Terms have the meanings set forth below.

(1) "User" means any individual who uses the Service.
(2) "Account" means identification information registered to use the Service.
(3) "Content" means check-in information, mood stamps, text, images, and all other information posted, sent, or shared by users through the Service.
(4) "Paid Plan" means subscription features available by paying a monthly or annual fee.

Article 2. Eligibility and Registration

1. The Service is available to persons aged 13 or older. Persons under 13 may not use the Service.

2. Users aged 13 or older but under 18 must use the Service with consent from a parent or guardian.

3. Users must enter and register true, accurate, and up-to-date registration information.

4. We may refuse or cancel registration if we determine that any of the following applies.
・The user has previously been suspended or removed for violating these Terms or similar reasons.
・Registration information contains falsehoods, errors, or omissions.
・We otherwise determine that registration is inappropriate.

Article 3. Account Management

1. Users are responsible for appropriately managing and maintaining their account information and authentication sessions.

2. Account information may not be transferred, lent, or shared with third parties.

3. If unauthorized use of an account is discovered or suspected, the user must contact us immediately.

4. Except in cases of our intentional misconduct or gross negligence, we are not liable for damages arising from unauthorized account use by a third party.

Article 4. Service Description

1. The Service is a communication app that allows users to share their current status with friends or watch-over partners through check-ins and mood stamps.

2. The main features of the Service are as follows.
・Posting and sharing check-ins and mood stamps
・Adding friends and managing friend lists
・Watch-over features for confirming the status of target users
・Real-time notifications through push notifications

3. Some features require subscription to a Paid Plan. Details and fees are displayed in the app.

Article 5. Paid Plans, Fees, and Payment

1. Fees for Paid Plans are the amounts displayed on the Apple App Store, including consumption tax where applicable.

2. Payment is made through the App Store payment system. Users may use payment methods specified by the App Store.

3. Paid Plans are auto-renewing subscriptions. Unless canceled at least 24 hours before the end of the current subscription period, the subscription renews automatically.

4. Renewal fees are charged within 24 hours before the end of the current subscription period.

5. Fee changes apply from the next renewal period.

Article 6. Cancellation and Refunds

1. Paid Plans must be canceled through the App Store subscription management screen.

2. After cancellation, the user may continue using Paid Plan features until the end of the current billing period.

3. Due to the nature of digital content and services, fees are generally non-refundable after purchase. However, refund requests based on Apple's refund policy are handled in accordance with the App Store rules and review process.

Article 7. Prohibited Acts

Users must not engage in any of the following acts when using the Service.

(1) Harassment, defamation, threats, or discriminatory statements toward other users
(2) Posting or spreading false or exaggerated information
(3) Acts that infringe another person's privacy, including sharing or tracking location information without permission
(4) Acts that infringe copyrights, trademarks, or other intellectual property rights of others
(5) Solicitation, promotion, or advertising through the Service, except as permitted by us
(6) Reverse engineering, disassembly, tampering, copying, or modification of the Service
(7) Unauthorized access or cracking of systems operated by us or third parties
(8) Access or operation using automated tools or bots
(9) Improper creation or operation of multiple accounts
(10) Acts that violate laws, regulations, or public order and morals
(11) Acts related to criminal activity or acts that encourage criminal activity
(12) Providing sexual or violent content to minors
(13) Any other acts that we reasonably determine to be inappropriate

Article 8. Special Provisions for Watch-Over Features

1. Watch-over features must be used based on the other party's consent. Users may not watch over another person without that person's consent.

2. Information obtained through watch-over features, including location and safety information, may not be used for purposes other than the intended purpose or provided to third parties.

3. We do not guarantee safety or security through the watch-over features. The features are communication support tools only. In emergencies, users must contact public authorities such as police or fire services.

Article 9. Rights in Content

1. Copyrights in Content posted or sent by users through the Service belong to the users.

2. Users grant us the right to use Content free of charge to the extent necessary to provide, operate, and improve the Service, including reproduction, modification, and public transmission.

3. Users warrant that Content they post does not infringe third-party rights. If a rights infringement occurs, the user is responsible for resolving it at the user's own cost and responsibility.

Article 10. Intellectual Property Rights

Copyrights, trademarks, and all other intellectual property rights related to the Service's application, design, logos, text, functions, and all other content belong to us or legitimate rights holders. Users may not reproduce, divert, reprint, modify, or otherwise use them without our prior written permission.

Article 11. Suspension and Account Removal

1. If a user violates these Terms, or if we determine that any of the following applies, we may suspend use, delete the account, or take other measures without prior notice.
・The user engages in acts prohibited by these Terms.
・The user causes or may cause damage to us or a third party.
・The user interferes with operation of the Service.
・We otherwise determine that continued use is inappropriate.

2. We are not liable for damages or any other responsibility arising from suspension, account removal, or similar measures taken by us.

Article 12. Changes, Suspension, and Termination of the Service

1. We may change, add, or remove Service content without prior notice.

2. We may suspend all or part of the Service in any of the following cases.
・System maintenance or inspection
・Natural disasters, power outages, or other force majeure events
・Other cases in which we determine suspension is necessary

3. If we terminate the Service, we will notify users in advance through the app, email, or another appropriate method, except in emergencies.

4. Except in cases of our intentional misconduct or gross negligence, we are not liable for damages incurred by users due to changes, suspension, or termination of the Service.

Article 13. Disclaimers

1. The Service is provided as-is. We do not warrant continuity, accuracy, completeness, or fitness for a particular purpose of the Service.

2. Disputes between users must be resolved between the users, and we are not responsible for such disputes.

3. The Service does not guarantee watch-over, safety, or security. In emergencies, users must contact public authorities such as police or fire services.

4. We are not responsible for impacts caused by outages, specification changes, or similar issues of external services, including the App Store, LINE, Apple, and Google.

Article 14. Damages

If we are liable to a user for damages, except in cases of intentional misconduct or gross negligence, the amount of damages is limited to the total amount of fees paid by that user to the Service during the most recent three months. This does not apply if this article is invalidated by the Consumer Contract Act of Japan or other mandatory laws.

Article 15. Changes to These Terms

We may change these Terms in the following cases.

(1) The change conforms to the general interests of users.
(2) The change is reasonable in light of the necessity of the change, the appropriateness of the changed content, and other circumstances related to the change.

The details and effective date of changes will be announced in advance through in-app posting, email, or another appropriate method. If a user continues to use the Service after the change, the user is deemed to have agreed to the revised Terms.

Article 16. Severability

If any provision of these Terms is held invalid or unenforceable under laws or regulations, the remaining provisions continue in full force and effect.

Article 17. Governing Law and Jurisdiction

These Terms are governed by and interpreted in accordance with the laws of Japan. If a dispute arises in connection with the Service, the Tokyo District Court has exclusive jurisdiction as the court of first instance.
